Legal Appeal

We continue to pursue our lawsuit against the County to reverse the rezoning approved by the County commissioners in Dec. 2023. The district court ruled against the appeal in August. We believe the district court judge made serious errors in her decision. That decision has been appealed to the Colorado Court of Appeals. Our opening brief was filed last week. Although these lawsuits are difficult to win, we are hopeful the appeals court will do a better job in considering our arguments. We anticipate a decision by the end of the year.

Status of Townhomes

During the appeal, the developer has chosen to move forward with the County approval process for the final design of the townhomes. Following approval of the rezoning, the next step was platting, more commonly known as subdividing. (Click here for info sheet.) The process includes providing detailed layouts showing each townhome lot (click to see), roads within the development and utility easements. Additional documents submitted include other engineering diagrams, a parking plan, soils and drainage reports, and a landscaping plan. Those documents have gone through three rounds of review by Jeffco Planning & Zoning staff and outside agencies. There will be at least one more round of review.

Once staff believes the application complies with the applicable zoning regulations and all other applicable regulations, it goes to a hearing by the Planning Commission. The PC makes a recommendation for approval or denial of the application. The Board of County Commissioners then holds a hearing to make the final decision whether to approve or deny the plat and related plans. There is a new developer on the project. Last year, the original developer, redT Homes, sold the development rights to Morgan Stonehill, a real estate development and investment firm based in Las Vegas with a second office in Denver. DWNA and Morgan Stonehill are having ongoing discussions on ways to mitigate some of the impacts the townhome development will have on the neighborhood.
